The Criminal Case Process

Though each case is different, here is a breakdown of the phases of a typical criminal case:

Arraignment

This is your first Court date. At this hearing, the Judge simply wants to know whether you are pleading "Guilty" or "Not Guilty" to the charges. By entering a plea of "Not Guilty" we are able to obtain and review all of the evidence in your case. It is always recommended to attend this hearing with an attorney by your side.

Pre-Trial

This phase consists of every hearing following your Arraignment but before the start of a Trial. It is in this phase that all evidence is turned over for us to review, any applicable motions in your defense are filed, and any settlement negotiations take place. Depending on the type of case, this phase can last anywhere from 3-12 months.

Trial

This is the final stage of a criminal case. Only about 2% of cases make their way to Trial -- most resolve in the Pre-Trial phase either through a dismissal or a negotiated plea agreement. Trial can never be forced on you. Instead, it is a Constitutional Right that you yourself must invoke.
